The Oklahoma Real Estate Commission passed a law in order to create a Real Estate Contract Committee. This Committee is responsible for developing Oklahoma Real Estate Commission approved real estate contracts and related forms for use by real estate licensees. The Real Estate Commission has developed numerous contract forms and related addenda which include residential sales, vacant lot(s) and land, farm and ranch properties and commercial and residential lease(s). In addition, a contract Information Booklet has been prepared. This Booklet provides the parties to a Real Estate transaction with additional information about particular contract provisions. It should be noted, however, that the Booklet mostly follows the OREC residential sales contract form.

This course will expose the learner to a number of the more common OREC approved Real Estate forms as well as give the learner an introduction to their use and effect.

Continuing education courses are required for sales associates and brokers who desire to renew their licenses on an active status.  A non-resident active licensee may apply for a license but they must have the following. 1) a minimum of two (2) years applicable active experience out of the previous five (5) years as a sales associate or broker, 2) provide a certification of licensure verifying such and indicating that the license is in good standing in their state or jurisdiction of licensure, 3) complete at least one (1) hour each in three (3) Oklahoma state specific courses: Contract and Forms (CON), Code and Rules (CAR) and Broker Relationship Act (BRA) 4) completes all appropriate forms and pays all required fees, which includes approval on the background check and 5) successfully pass the required examination.

Provisional Sales Associates are required to complete the Part II post-license course within the first six months of obtaining their Provisional Sales Associate License. You must not begin this course until AFTER YOUR PSA LICENSE HAS BEEN ISSUED by the Commission.

In the course of duty, real estate professionals must be knowledgeable about short sales and have the ability to counsel clients effectively in coordination with appropriate tax and legal experts.

Real estate salespeople may encounter such a scenario during a listing discussion when it becomes obvious that the optimal selling price for the property is less than what is owed on the mortgage. Or it may be a condition of sale when engaged in the representation of a buyer interested in purchasing such a property.

Individual circumstances make each short pay transaction different, but pre-foreclosure home sales can be expected to be a challenge requiring knowledge, negotiating skill and patience. For the uninformed entering into a short sale transaction without a comprehensive understanding of the process, it can be a frustrating undertaking with potential for severe financial repercussions for the client.

54.5 cents for business;
14 cents for charitable purposes
18 cents for medical care or deductible moving expenses

Business Miles: 20,000
Mileage Rate: 58 cents per mile for business miles driven
Deduction = $11,600
(20,000 x 0.58 = 11,600)

Rick will be able to deduct up to $1,600 of his paid interest, which represents 80% of the total interest paid.
If a taxpayer uses more than one automobile in business, the total miles for all autos used can be considered when using the regular/standard mileage method of deducting automobiles. The IRS allows up to four cars to be used.
When a taxpayer trades in his or her present vehicle for a new or different one, there are tax considerations.

The CARES Act of 2020 changed the age for Required Minimum Distributions (RMD) of any retirement plan from age 70-1/2 to age 72.

As a result of the TCJA, the penalty for failure to have ACA-compliant insurance has been eliminated starting in 2019. The deductible threshold for medical expenses has been reset to 7-1/2% of Adjusted Gross Income beginning in 2020.

For the sole proprietor, health insurance is an adjustment to income on Form 1040, rather than an expense on Schedule A. For the S-Corp owner, the corporation can pay the cost of health insurance, but this does raise issues that the tax professional must deal with.

There’s more to it than these simple statements, so consult a tax professional.

The purpose of this class is to alert brokers to those situations that may cost them large amounts of money, or their license, or both. The course will help protect the public by educating brokers to recognize bad business practices. To be successful in the real estate business world, risks are taken daily. Sales people tend to be risk takers by nature. Our industry has evolved from a "buyer beware" philosophy to "broker beware." Courts are upholding decisions that assign more and more liability to the broker for the problems buyers and sellers experience in their real estate transaction. Now, more than ever, it is imperative that brokers employ all their skills, care, and diligence in the conducting of their business. Brokers should understand that no course substitutes for attorney advice. Each legal situation is different, and the advice of an attorney will guide the broker through the maze of small, but important legal considerations.

This course is intended to make you think and understand the various complex issues in today's real estate business. Many brokers think their errors and omissions insurance will cover them if a legal problem arises. Not so, fraud is usually not covered, and usually the plaintiffs will allege that that is where the broker began to be a problem. A mistake here will be paid from the broker's wallet. Take unauthorized practice of law seriously. Never use "standard clauses" without consultation with at least your broker and/or your attorney. Work hard at understanding the ramifications of the things you write, say, do, or elect not to do. Think before you act!
